A processing operator from Georgia was forced out of work due to severe pain issues. After several years receiving Long Term Disability benefits, Guardian suddenly denied her Long Term Disability claim.

Our attorneys drafted an appeal, providing the insurer with significant evidence supporting her disability claim, including extensive medical records, testimonies from our client’s physicians, and other important information. Wilson – Service Technician – Calhoun, Georgia

Congestive Heart Failure, History of Stroke

A service technician for a large trucking company in Georgia suffered a stroke due to a chronic heart condition. This left him with chronic weakness, speech difficulties, and cognitive impairments. He was no longer able to work, applied for disability benefits, and was initially approved. After two years of benefits, when the definition of “disabled” under his policy changed, Mutual of Omaha terminated the claim.

In response to the termination, our client reached out to Fields Law. Our attorneys wrote an appeal which included updated medical information, outlined the symptoms that the client dealt with daily, and illustrated why he was unable to work even an unskilled, sedentary occupation. On review, Mutual of Omaha overturned their termination, made payment to the client of benefits that were past due, and resumed paying his monthly benefits.

Spinal Stenosis

A County Tax Appraiser became disabled after a diagnosis of permanent spinal stenosis. Because she loved her job, she continued to do her work for several months, without complaint. When it became too painful, she had no choice but to apply for Long Term Disability. Despite her debilitating condition and the clear evidence supporting the same, the disability carrier denied her claiming that she could perform the work of a tax appraiser. It was clear the disability carrier did not understand the physically challenging nature of such an occupation. Her job demanded she travel out into the field to visually and physically examine machinery and other objects, which necessitated walking long distances, climbing, kneeling, reaching, lifting and standing for lengthy periods of time.
