Short & Long Term Disability Cases We’ve Won for Our Clients Against Mutual of Omaha
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against Mutual of Omaha.
Richard – Transport and Correctional Officer – New Castle, Indiana
Severe Diverticular Disease of the Colon
A transport and correctional officer in Indiana stopped work due to complications from a perforated colon caused by severe diverticular disease. A policyholder, they applied for Long Term Disability benefits through Mutual of Omaha. Despite multiple procedures and surgeries, inpatient hospital stays, and ongoing outpatient therapies, the claim was denied. The insurer asserted that absences from work disqualified coverage, even as the medical record documented significant functional limitations.
Fields Law handled the administrative appeal with a focused, evidence-driven approach. The Fields attorneys obtained and organized key medical records and work history to demonstrate that the policyholder met the policy’s definition of disability and remained eligible for coverage. As a result, Mutual of Omaha reinstated benefits and issued back pay for the full period the benefits had been denied.
Librado – Systems Support Technician – Bakersfield, California
Cervical Radiculopathy, Myalgia, Muscle Weakness, Paresthesia of the Skin
A systems support technician from California had to stop working due to his painful, disabling medical conditions, including cervical radiculopathy, myalgia, muscle weakness, and paresthesia of the skin. Although his claim for Short Term Disability was approved by Mutual of Omaha, his subsequent claim for Long Term Disability was denied.
Unable to work, and now without his financial safety net, he reached out to Fields Law for assistance. The Fields team gathered medical records and a Functional Capacity Evaluation that showed our client’s inability to work. The attorneys drafted an appeal, urging Mutual of Omaha to grant the client the benefits to which he was entitled. His Long Term Disability benefits were granted, and he received a check for the backpay that had accrued on his claim.
Thomas – Trail Builder – Fayetteville, Arkansas
Spinal Surgery Complications, Spondylitis of the Thoracolumbar Region, Low Back Pain
A trail builder in Arkansas was forced to stop working due to disabling medical conditions, including complications from spinal surgery and spondylitis of the thoracolumbar region. Initially, he was approved for Long Term Disability benefits. Then, after 10 months, Mutual of Omaha abruptly terminated his benefits.
He reached out to Fields Law for assistance, and our team appealed the termination. After providing the insurer with significant evidence supporting the client’s disability claim, Mutual of Omaha reinstated our client’s benefits and sent him all the backpay he was owed.
