Short & Long Term Disability Cases We’ve Won for Our Clients Against New York Life
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against New York Life.
Patricia – Warehouse Associate – Memphis, Tennessee
Veritgo, Fibromyalgia
A warehouse associate from Tennessee became disabled when she developed vertigo and fibromyalgia. Her insurer paid her Short Term Disability for a few months before discontinuing benefits, stating that her medical records failed to show she was unable to perform her job. Concerned, she decided to hire Fields Law Firm to appeal the wrongful denial. Our attorneys collected medical records and medical information from her doctors. In conjunction with legal arguments, the medical information was submitted to New York Life for review. They reversed their decision and reinstated our client’s Short Term benefits. Our client was grateful to have her financial security restored.
Maria – Machine Operator – Chattanooga, Tennessee
COPD, Sarcoidosis, Hyertension
A machine operator from Tennessee was suffering from COPD, sarcoidosis, and hypertension. She was removed from work by her treating doctors, as it was no longer considered safe. Next, she applied for Long Term Disability benefits through her employer’s plan. Unfortunately, the insurance company denied the claim stating there was a lack of medical evidence supporting that she could not perform her Own Occupation.
Distraught, she turned to Fields Law for help. Although her case required two separate appeals, our team was able to convince New York Life to reverse its denial, pay our client her back pay, and start paying monthly benefits. We secured narrative reports from her treating providers, all of the medical evidence related to her claim, and her entire Social Security Disability file, all establishing she could no longer perform her Own Occupation.
Jason – Material Handler – Greeneville, Tennessee
Aortic Aneurysm, Chronic Neuropathy, Pain, Fatigue
A man from Tennessee had worked for many years as a material handler but, because of a serious heart condition, he was unable to continue working. His symptoms included chronic fatigue, neuropathy, and numbness. His Long Term Disability insurer initially approved his claim and paid benefits for two years. They later cut him off stating that he had the ability to perform other jobs.
He reached out to Fields Law, and our attorneys reviewed all of the records New York Life had and orderd updated medical records. Based upon our review of the file and the updated medical information, we drafted an appeal which argued the denial was improper. On appeal, New York Life reversed their decision and reinstated the payment of monthly benefits.
