Short & Long Term Disability Cases We’ve Won for Our Clients Against New York Life
Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal case wins against New York Life.
Virgina – Customer Service Clerk – Perth Amboy, New Jersey
Herniations at Lumbar, Thoracic, and Cervical Spine, Radiculopathy of Arms and Legs
A Customer Service Clerk in New Jersey developed multiple herniations to her Lumbar, Thoracic, and Cervical spine. These disc herniations caused shooting pain and numbness down one of her shoulders, into the arm, and down her back, into her legs. Her treating doctor advised she stop working, so she applied for Long Term Disability through her employer’s plan. New York Life denied the claim after its in-house doctors reviewed her medical records. They told her that their doctors had determined her conditions were not severe enough to support limitations and restrictions, so from their point of view she could work full time.
Fields Law successfully argued that New York Life’s doctors selectively cited and ignored critical information from the medical records, and that our client’s treating physician was in the best position to assess her conditions. Consequently, New York Life overturned its decision, paid our client her back pay, and commenced monthly benefit payments.
Tammy – Project Manager – Waxhaw, North Carolina
Ruptured Colon and Associated Complications
A project manager for a consulting firm suffered from a ruptured colon, and later suffered from complications from multiple surgeries, septic shock, and tearing of her intestines. Clearly, she was unable to continue working. Her Long Term Disability carrier accepted her claim and paid benefits. New York Life later cut off her benefits claiming that she could resume work as a project manager.
Unable to work and unsure of what she could do, she reached out to Fields Law. The Fields Law attorneys began reviewing the entire file from New York Life. We also obtained all of our client’s medical records. With all of this information, our attorneys drafted an appeal which highlighted the medical evidence that our client was disabled and the faults with New York Life’s review. Upon review, New York Life reversed their decision and reinstated her monthly benefits. Our client was happy to have her benefits reinstated and her income restored.
Christine – Marketing Director – Hickory, North Carolina
Multiple Sclerosis
A marketing director from North Carolina began having weakness and numbness in her limbs. Her doctor ran tests and diagnosed her with multiple sclerosis. Her symptoms worsened, and eventually she could no longer work. She put in an application for Short Term Disability benefits, but she knew that her condition would likely be chronic and degenerative.
In anticipation of needing Long Term Disability benefits, she contacted Fields Law before her Short Term Disability benefits expired. The Fields Law attorneys gathered medical records and prepared the file for application. Our attorneys kept in close contact with the insurance company to ensure the application had no weaknesses or missing documents. Our support staff kept our client updated every step of the way and even helped with a Social Security Disability application for benefits. Ultimately, the insurer approved our client for benefits. She is happy that Fields Law handled the application and communication with the insurance company efficiently, and she can now focus on long-term treatment.
