Elizabeth – Registered Nurse – Arroyo Grande, California

Chronic Back Pain

A registered nurse from California suffered from chronic and severe back pain. This condition prevented her from being able perform any work, as she could not stand or walk without being in agony. Her Long Term Disability insurer denied her claim asserting that the medical information on file showed that she was capable of performing her own occupation.

Unable to work and scared about what to do, she reached out to Fields Law and our attorney knew exactly what to do. After completing his review of the insurance company’s file, her attorney developed a winning strategy for her appeal. He updated medical records which showed the chronic pain the client was experiencing. With the updated records, he then drafted an appeal which laid out the argument that her back condition was so serious that there was no way she could work. He also argued against the reasoning from the insurance company for their denial, highlighting the inconsistencies and failures in their review. The insurance company reversed their decision and reinstated our client’s monthly benefits.

A Project Coordinator from California applied for and was denied for Long Term Disability benefits through an insurance company policy provided by her employer. Lincoln Financial notified her that it was denying Long Term Disability benefits based on their determination that she could work her regular occupation, which was considered sedentary. She knew she could not continue to do her job. She did some research on how best to fight back against Lincoln Financial’s wrongful denial and came across Fields Law Firm.

Once retained, the attorneys at Fields Law acquired medical records, a narrative report from a treating doctor, and two functional capacity assessments from her treating doctors, and submitted an appeal. Lincoln Financial initially tried to maintain their denial and threatened to send our client to one of their doctors for a medical exam. However, the evidence and arguments submitted by the attorneys at Fields Law was too much for Lincoln Financial to argue against, and they approved our client’s benefits.

David – Long Haul Trucker – Bakerfield, California

Lumbar Stenosis

A Long Haul Trucker from California developed severe low back pain that rendered performance of his work duties impossible. Luckily, he had recently elected disability coverage through his employer. He submitted his claim, however, Guardian denied benefits stating his conditions were pre-existing. However, he had clearly not treated for his low back during the period of time in question.

On appeal, the Fields Law attorneys compiled medical information to unequivocally show that our client did not treat for his low back conditions during the time period in question. After review of the appeal, Guardian approved the claim and our client received a check for all past-due benefits.
