Nanette – Sales Executive – Holiday, Florida

An In-House Sales Executive became disabled due to conditions relating to her knee. She was approved for Short Term Disability, but when she applied for Long Term Disability benefits, she was denied. Her Long Term Disability application was denied because Unum claimed she did not meet the definition of disabled. Upset by the sudden loss of income, she contacted the attorneys at Fields Law to appeal Unum’s denial decision. The Fields Law attorneys compiled all her medical records, obtained favorable reports from her treating doctors, and submitted a comprehensive appeal. Unum, after only a few weeks, overturned its prior denial of benefits and retroactively paid back our client’s outstanding disability benefits.

An Engineer and military veteran began receiving Long term Disability benefits due to post traumatic stress disorder, anxiety disorder, and Tourette syndrome. After years of receiving benefits, based on a brief conversation with his treating doctor, and with no independent medical examination, Metlife discontinued disability benefits and stated that he could return to work.

Upset with the Metlife’s sudden termination of benefits, he called Fields Law to assist with an appeal. Our attorneys spoke with the treating physician who the insurer contacted initially and discovered that his meaning was misinterpreted by Metlife. The attorneys at Fields Law gathered a complete medical record from three treating doctors to mount a strong appeal for our client. The appeal was successful and our client was relieved to have his disability benefits reinstated.

Sherri – Occupational Therapist – Cape Coral, Florida

Lymphocytic Colitis

An occupational therapist from Florida was diagnosed with lymphocytic colitis. The disease resulted in urinary and fecal incontinence, diffuse joint pain, and severe fatigue. She was no longer able to perform her job as an occupational therapist. Her Long Term Disability insurer paid her benefits agreeing she was disabled from her Own Occupation. However, when the definition of disability changed to Any Occupation, her insurer denied the claim asserting that she had the functional capacity perform sedentary work.

She decided to hire Fields Law and her attorney collected substantial evidence from her medical providers showing she was unable to work in any capacity. The insurance company performed a review and agreed our client continued to be disabled from Any Occupation. Our client was relieved with the outcome and was able to pay off the debts she had amassed while her benefits were cut off.
