Mike – Maintenance Mechanic – Marceline, Missouri
Epilepsy
A maintenance mechanic from Missouri left work when he lost control of his epilepsy and he began experiencing increasingly frequent and severe seizures. He was unable to keep up with his heavy work as a maintenance mechanic. He submitted a claim to for disability benefits which was approved and paid for two years. However, when the definition of disability changed from the “Own Occupation” standard to the “Any Occupation” standard, CIGNA stated he could work at several desk jobs.
He reached out to Fields Law Firm for assistance with the denial of his claim. We assisted our client in appealing the denial decision and proved conclusively that he was unable to work due to uncontrolled epilepsy. CIGNA reinstated his claim and paid all outstanding benefits.
Arnold – Public Works – Minneapolis, Minnesota
Camptocormia (Bent Spine Syndrome), Congestive Heart Failure, Advanced Osteoarthritis
A Minneapolis man had worked as a Machinist for over 35 years before being forced to leave work as a result of developing camptocormia, congestive heart failure and advanced osteoarthritis of the knees. He applied for Long Term Disability benefits from his insurance carrier, but was denied. He appealed the insurer’s denial once himself, but received a subsequent denial from the carrier.
Knowing he needed help, he retained Fields Law to represent him and fight the insurance company. His Fields Law attorney began building his appeal by reviewing the insurer’s denial letter claims and drafting pointed arguments to counter them. The Fields Law team also acquired significant medical records proving our client’s disability and a narrative report from his primary treating physician and submitted the completed appeal. After reconsideration, the insurer overturned their prior denial and approved our client’s benefits. He soon also received a check for the back benefits from his date of disability.
Angela – Classroom Teacher – Minneapolis, Minnesota
Head Injury
A Minnesota employee had worked as Classroom Teacher for a public school before becoming disabled after suffering a head injury following a motor vehicle accident. By an impersonal letter, her Long Term Disability insurance carrier notified this teacher that her disability benefits were denied because she no longer met the definition of disability. Voya claimed that there was no medical evidence to support her inability to perform the Material and Substantial duties of her Regular Occupation.
Upset at her sudden loss of income, she called Fields Law for help appealing Voya’s decision. The attorneys at Fields Law contacted our client’s doctors to compile reports of all of her symptoms and treatments, as well as narrative reports. After submitting her appeal, Voya reversed its previous decision and issued a check for the months it failed to pay this teacher.
