Here are just a few examples of our Long Term Disability appeal case wins against various insurers.
Patricia – Warehouse Associate – Memphis, Tennessee
Veritgo, Fibromyalgia
A warehouse associate from Tennessee became disabled when she developed vertigo and fibromyalgia. Her insurer paid her Short Term Disability for a few months before discontinuing benefits, stating that her medical records failed to show she was unable to perform her job. Concerned, she decided to hire Fields Law Firm to appeal the wrongful denial. Our attorneys collected medical records and medical information from her doctors. In conjunction with legal arguments, the medical information was submitted to CIGNA for review. They reversed their decision and reinstated our client’s Short Term benefits. Our client was grateful to have her financial security restored.
Jana – Staffing Coordinator – Dandridge, Tennessee
Spinal Stenosis in Lumbar and Cervical Spine, Fibromyalgia, Hypothyroidism
A Staffing Coordinator for a large tire manufacturer was forced to stop working due to spinal stenosis of her lumbar and cervical spine, fibromyalgia, and hypothyroidism. She applied for Long Term Disability benefits and received them for almost one year. One day, out of the blue, she received a letter from stating that medical personnel from CIGNA reviewed her claim and determined that she could go back to work. These medical personnel gave these opinions without ever even meeting her.
She turned to Fields Law Firm for help. Our attorneys crafted an appeal in which we argued that CIGNA misconstrued the nature of our client’s job and the physical requirements associated with it. Furthermore, we argued that it was wrong to rely on doctors who had never met or examined her. After Fields Law submitted the appeal, CIGNA reviewed the evidence and admitted they made a mistake by discontinuing her benefits. They issued a check for the past due benefits that they owed to our client, who was very happy she entrusted Fields Law to handle her appeal.
Maria – Machine Operator – Chattanooga, Tennessee
COPD, Sarcoidosis, Hyertension
A machine operator from Tennessee was suffering from COPD, sarcoidosis, and hypertension. She was removed from work by her treating doctors, as it was no longer considered safe. Next, she applied for Long Term Disability benefits through her employer’s plan. Unfortunately, the CIGNA denied the claim stating there was a lack of medical evidence supporting that she could not perform her Own Occupation.
Distraught, she turned to Fields Law for help. Although her case required two separate appeals, our team was able to convince CIGNA to reverse its denial, pay our client her back pay, and start paying monthly benefits. We secured narrative reports from her treating providers, all of the medical evidence related to her claim, and her entire Social Security Disability file, all establishing she could no longer perform her Own Occupation.
