Yinzi – Bio Chemist – Ardsley, New York

Congestive Heart Failure, Complications from Heart Transplant, Shortness of Breath

A bio-chemist from New York began having shortness of breath and heart palpitations. Her doctors diagnosed her with congestive heart failure and put her on a transplant list for a new heart. She stopped working and received Long Term Disability benefits through her employer. The surgery was successful, but her symptoms continued. After seven years of receiving benefits, her insurance company stopped paying because she didn’t fit their definition of disabled.

Worried about her lost income, she called Fields Law for help. Our team reviewed all our client’s records and called two physicians for narrative reports to illustrate her condition more clearly to Lincion Financial. Both doctors said that she could not work in any capacity due to exertion-based shortness of breath. The Fields Law attorneys submitted the new reports with a strong appeal to Lincoln Financial, and the decision was overturned. Our client received a lump-sum check for back-pay and ongoing benefits. A refrigeration mechanic left work when he started to experience severe vertigo and dizziness. He submitted a claim for disability benefits to his insurance company who denied his claim, stating the medical records did not support an inability to perform the duties of his own occupation. He was shocked because his symptoms precluded him from even being on his feet. He could not lift up to one hundred pounds as his job required.

The Fields Law attorneys filed an appeal in support of disability benefits for our client. We argued that the symptoms he experienced would make the performance of his heavy-duty job impossible. Lincoln Financial briefly reviewed the appeal and medical information our attorneys provided and overturned their denial.

A Senior Finance Manager from New Jersey found out she was no longer able to work due to anxiety, depression, lupus, heart conditions, back conditions, fatigue, and migraines. The employer provided both Short Term and Long Term Disability policies, which she elected to receive coverage under both policies. She was initially approved for Short Term Disabillity benefits and received weekly pay for almost five months.

However, the insurer terminated her Short Term Disability benefits because they concluded that she did not meet the Definition of Disabled any longer. Lincoln Financail also denied her application for Long Term Disability benefits for the same reason. Upset with the illogical decision to terminate Short Term benefits, and outright deny Long Term Disability benefits, she contacted Fields Law Firm to submit an appeal of both adverse decisions.

The attorneys at Fields Law pulled together all of our client’s medical records and generated reports. We sent our client to a neurophysiological functional capacity evaluation, which generated a report of cognitive functional abilities. Equipped with a comprehensive appeal and substantial favorable medical records, the attorneys at Fields Law submitted an appeal. Lincoln Financial issued a new decision and overturned its prior termination of Short Term Disability benefits, and its prior denial of Long Term Disability benefits. Lincoln Financial proceeded to issue a backpay check for the months that it failed to pay our client previously on both the Short Term Disability and Long Term Dissability policies.
