Fields Law Firm successfully recovers millions of dollars each year for our disabled clients throughout the United States. Our Long Term Disability experience is matched by very few other law firms in the country and has earned us a national reputation.
Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Michigan.
George – Driver – Southfield, Michigan
Glaucoma, Neck Pain
A driver for a courier service became disabled when he developed glaucoma and neck pain. As a result, he was unable to work. His insurance company denied his claim for the outset, stating that his conditions fell under a pre-existing condition provision in his policy.
Not sure what he should do, he reached out to Fields Law Firm. Our attorneys researched the effective date of the policy to determine if the pre-existing condition clause was valid. Additionally, we closely analyzed the medical records and determined that, even if the pre-existing clause was valid, our client’s neck pain did not meet the definition of pre-existing. On appeal, Unum reversed their decision and paid all past-due benefits. Our client was very happy that he had a livable monthly income again.
Jayne – District Manager – Howard City, Michigan
Complications Due to Stroke
A district sales manager from Michigan suffered a stroke. As a result, she had limited use of the right side of her body as well as difficulty with speech. Her Long Term Disability insurer initially accepted her claim but after three years, CIGNA denied the claim. Their denial stated that the medical information available did not prevent her from working a sedentary occupation.
Not sure what he should do, she reached out to Fields Law. Our attorneys ordered updated medical records and obtained statements from our client’s treating doctors. We also had our client undergo a functional capacity evaluation. Armed with all of this evidence, our attorneys drafted a winning appeal. CIGNA reversed their decision and reinstated our client’s benefits and paid all the past-due benefits.
Thomas – Lumber Yard Manager – Chesterfield, Michigan
Chronic Neck Pain, Neck Fusion Surgery, Weakness throughout both Upper Arms, Gait Instability
A lumber yard manager from Michigan was suffering with chronic neck pain after undergoing a multilevel neck fusion surgery. He was removed from work and his treating providers noted he could not return to the physical nature of his previous occupation. He applied for Long Term Disability benefits through his employer’s plan. Unfortunately, the insurer denied the claim based on its review. Greater Georgia Life stated he could continue to perform the material duties of his occupation.
He turned to Fields Law for help. Our team worked with our client to build an appeal fighting this denial. We wrote to our client’s doctors receiving extensive narrative reports specifically responding to the Greater Georgia Life’s grounds for denial. Additionally, we pointed out substantial errors in the review that failed to consider all the relevant evidence in the claim file. After receiving our appeal, Greater Georgia Life reversed its decision, paid our client his backpay, and commenced monthly Long Term Disability benefits.
