Here are just a few examples of our Long Term Disability appeal and lawsuit case wins in Minnesota.
Nicole – Underwriter – Cottage Grove, Minnesota
Chronic Degenerative Hip Disease
An Underwriter from Minnesota suffered from chronic hip degeneration her entire life and underwent a dozen surgeries prior to the age of 20. She was able to work sedentary jobs, but eventually, her condition became too severe and she was forced to stop full time work. She found a part-time job, was approved for partial benefits, and received benefits for four years. After her case was transferred to a different claims manager, Principal discontinued her benefits and said she could return to full-time work.
Worried about her lost income and still suffering from chronic pain, she contacted Fields Law for help. Our attorneys drafted a strong appeal refuting Principal’s arguments and highlighting our client’s most recent medical treatment. Principal reversed its denial decision. Our client received a lump-sum payment for back pay and her monthly benefits once more.
Anne – County Recording Clerk – Maplewood, MN
Rheumatoid Arthritis, Trigger Finger, Chronic Low Back Pain, Chronic Right Wrist Pain and Swelling, Osteoarthritis Bilaterally in the Knees, Chronic Left Hip Pain, Chronic Fatigue
A County Recording Clerk in Minnesota ceased working at the recommendation of her doctors due to a progression of her rheumatoid arthritis, trigger finger, chronic fatigue, and osteoarthritis in her knees, hips, and low back. She applied for disability benefits, but Madison National denied her Short Term Disability benefits and her application for Long Term Disability benefits. Unsure where to turn next, she reached out to the Fields Law Firm to appeal her Short Term and Long Term claim decisions.
The Fields Law team gathered additional medical records, and a narrative report from our client’s treating doctors. The Fields attorneys submitted an appeal, but Madison National reviewed and upheld its original decision because our client returned to work after surgery and physical therapy, and Madison National used the return to work to assert that she was never disabled from performing her own occupation.
With a second appeal available, our team obtained additional updated medical evidence and additional supportive narrative reports stating that our client’s ability to return to work was due to her physical therapy and time off work to recover from her surgery. After review, Madison National overturned its denial and approved all of her Short Term Disability benefits and two months of Long Term Disability benefits.
Cory – Police Officer – Lakeville, MN
PTSD, Alcohol Use Disorder, Degenerative Left Hip Disorder, Multi-level Degenerative Disc Disease, Disc Bulges, Nerve Root Compression
A Police Officer in Minnesota was in an officer involved shooting and developed severe PTSD. That condition, alongside an ongoing degenerative disc disorder, ultimately forced him out of work. He applied for Long Term Disability benefits, but Madison National denied his claim for benefits, stating that his conditions didn’t prevent him from doing his job.
Knowing he needed help, he retained Fields Law Firm to fight for his benefits. Our team requested additional updated documentation, and supporting reports from his treating providers. The managing attorney wrote an appeal critical of the reasoning for their denial with additional supporting documentation. After months of reviewing the appeal, the insurer overturned the denial. Our client was paid for all past due benefits, and was reapproved for ongoing benefits.
